The Supreme Court judge DY Chandrachud remarked on Saturday that the Dabur Karwa Chauth commercial portraying a same-sex pair had to be deleted due to "public intolerance," reflecting on the gap between laws aimed at removing societal disparities and the reality on the ground.

Last week, FMCG giant Dabur retracted a commercial featuring a same-sex couple enjoying the Hindu holiday of Karwa Chauth, just hours after Madhya Pradesh Home Minister Narottam Mishra threatened legal action, calling the image "objectionable."

"All of you would have heard about this advertisement that a corporation was obliged to take down just two days ago. It was a commercial for a same-sex couple's Karva Chauth. According to LiveLaw, Justice Chandrachud declared at a public gathering, "It had to be dropped on the basis of public intolerance!" He was addressing at the National Launch Of Legal Awareness Programmes by NALSA in cooperation with the National Commission for Women on 'Empowerment of Women Through Legal Awareness.'

While the Constitution provided remedies for deep-seated inequality and patriarchy in India, Chandrachud stated that there remained a significant gap between the law's aspirations and the current reality of society.

"Our Constitution is a game-changing text that aimed to address patriarchy's underlying injustices. It has evolved into a potent tool for securing material rights and public affirmations of women's dignity and equality. To attain the purpose of ensuring women's constitutional rights, legislation such as the domestic violence act and the prevention of sexual harassment at work act have been adopted. However, as Supreme Court judges, we encounter injustice against women on a daily basis. There are real-life examples that demonstrate a significant gap between legal aspirations and the current state of society," remarked Justice Chandrachud, the Chief Justice of India.
