A long and bitter 10-year marital dispute has ended in the Supreme Court of India, which here has declared it a matrimonial battle of Mahabharata, which has gone beyond all boundaries. On the grounds of irretrievable breakdown, its extraordinary powers as provided in Article 142 of the Constitution were invoked by a bench of Justices Vikram Nath and Sandeep Mehta to dissolve the marriage.
The court dismissed more than 80 cases brought by the lawyer-husband against his wife, her family, and even her legal counsel because the lawyer was seen to be abusing his legal knowledge to extend proceedings and be a delaying factor. The couple, married in 2010 and blessed with two sons, spent years living apart due to their numerous court cases.
In an attempt to deliver perfect justice, the Supreme Court ordered the husband to deliver a consolidated amount of ₹5 crore to the wife as permanent alimony, past and future alimony, child support, and cost of litigation. It is payable in one year, in a lump sum or four quarterly installments. The wife was assigned custody, but the father was allowed to visit the children. The decision will offer repose to the battle that has been going on over a ten-year period and deliver a truce between these two parties.
