Judging critically, the Jharkhand High Court handed down a stern verdict in a prominent case of alimony, raising the amount asked to be paid by a tech professional to ₹70 lakh instead of ₹40 lakh as alimony dues. The IT engineer had filed an appeal against the earlier order made by the family court with the High Court, saying it was undue.
His plea for less alimony was, however, rejected by the High Court, which increased the spousal support on the basis that the wife was financially dependent on him, had no independent financial source, and the husband was gainfully employed. The bench had pointed out the husband's duty to support his former wife in having a dignified life after the divorce.
The case also brings to light the increase in the quantum of alimony awards in India, particularly where there is a substantial difference in income. According to legal sources, the High Court's judgment has clearly conveyed that frivolous attempts to challenge maintenance-related orders may lead to increased liabilities. The amount has been enhanced, and the husband has been given time to cover the money.
