President Donald Trump signed two executive orders on August 6, 2026, aimed at ending “birth tourism” and narrowing certain applications of birthright citizenship. The move follows a Supreme Court ruling that struck down a broader earlier attempt to restrict automatic citizenship for children born in the United States.

One order defines birth tourism as entering the US on a nonimmigrant visa primarily to give birth on American soil. It directs the Secretaries of State and Homeland Security to deny visas, revoke existing authorizations, bar entry, and remove individuals engaged in or facilitating the practice.

The administration argues the practice exploits immigration laws through deceptive travel and commercial networks. Estimates of annual birth-tourism cases range from about 10,000 to 26,000, a small fraction of total US births. Critics note the practice was already restricted under existing visa fraud rules, while supporters say stronger enforcement protects the value of American citizenship. Further guidance from agencies is expected in the coming weeks.
